About the Colin The Caterpillar™ backpack Promotion
1. This promotion is being operated by Marks and Spencer plc, Waterside House, 35 North Wharf Road, London W2 1NW (“M&S”) and the National Trust (Enterprises) Limited, Heelis, Kemble Drive, Swindon, Wiltshire SN2 2NA ("National Trust").
2. M&S have collaborated with the National Trust to offer Sparks Customers the opportunity to receive a 50% discount on standard admission to participating National Trust property when they purchase a promotional Colin The Caterpillar™ backpack (the "Promotion").
3. M&S will process any personal data you provide in accordance with the General Data Protection Regulation and other applicable privacy laws. For more information, see the M&S Privacy Policy by clicking here OR on our website marksandspencer.com.
4. By accepting the Promotion and purchasing the Colin The Caterpillar™ backpack (UPC 29392209) and scanning your Sparks at the checkout, you agree to the below terms and conditions and to receive email notifications from M&S in relation to the Promotion. You can update your marketing preferences in the ‘My Account’ section of the M&S App or online at any time.
The Promotion
5. This Promotion is open only to permanent UK residents who are aged 18 years or over. Employees (or their relatives) of the Marks and Spencer Group of Companies (or any other company and/or agency connected with this promotion) are permitted to participate.
6. The Promotion will be available instore only from 00:01 on the 2nd April 2024 until 23:59 on 6th September 2024, subject to availability.
7. The Promotion gives Sparks Customers the opportunity to receive a 50% discount on standard admission to a participating National Trust property when they purchase a promotional Colin The Caterpillar™ backpack. The 50% off admission offer is applicable to a maximum of two (2) adults and maximum of three (3) children (aged 5-17 years inclusive). Additional adults or children will be charged at the full admission rate. Children under five (5) years visit free.
8. Customers must scan their Sparks at the checkout when purchasing the Colin The Caterpillar™ (UPC 29392209) in order to qualify for the Promotion. On doing so, the National Trust 50% off admission offer will be automatically added to your Sparks account (visible on the App or online). Qualifying customers will also be sent a notification email to let them know the offer has been added to their Sparks account. You will need to be opted in to M&S marketing communications to receive this email.
9. To use the offer, customers must access their Sparks account online or via the M&S app and click the button on the offer. This will take the customer to the National Trust’s ticketing website (‘DigiTickets’), where the customer will be asked to fill in a form to receive their voucher.
10. This Promotion cannot be used in conjunction with any other promotion or offer.
11. By redeeming the Promotion on the National Trust website, you consent to M&S and the National Trust sharing your Sparks number between them.
Using your National Trust discount offer
12. The validity period of the 50% discount offer is from 00:01 on 8th April 2024 to 23:59 on the 15th September 2024, excluding all bank holidays and bank holiday weekends, during advertised opening hours (see https://www.nationaltrust.org.uk ).
13. The purchase of one (1) Colin The Caterpillar™ backpack (UPC 29392209), using Sparks enables one (1) discount voucher to be downloaded only.
14. The 50% discount voucher can be used once only against standard admission tickets at participating National Trust properties. At venues where advanced booking is required, present both the booking confirmation and the 50% discount voucher to guarantee entry. Without the voucher, you will not receive discounted entry and will be charged the full admission price.
15. National Trust properties excluded from the promotion are listed here: https://www.nationaltrust.org.uk/services/help-centre/places-which-are-exempt-from-admission-promotions Sparks Customers should check the excluded properties in advance of travelling as the full admission price will be charged at a property excluded from the Promotion.
16. This 50% discount voucher can only be used one (1) time, against eligible standard admission tickets at participating National Trust properties.
17. This voucher can be used against tickets for a maximum of two (2) adults and maximum three (3) children (aged 5-17 years inclusive).
18. Additional adults or children will be charged at the full admission rate and under children under five (5) years old visit for free.
19. The offer can be used against standard adult, child and family admission tickets only. National Trust membership, group tickets, Gift Aid tickets, chargeable event tickets, and car park charges are excluded from this offer.
20. The offer cannot be used at places with special admission agreements, such as English Heritage (including Stonehenge and Housesteads Fort) or National Trust for Scotland.
21. Without proof of the Sparks discount voucher, the offer cannot be redeemed and all paying visitors will be charged the full admission price.
22. Some National Trust properties require booking in advance of the visit date, please check the property’s website prior to visiting to check whether this is the case with your chosen property and to book tickets. At these properties, without a booking we cannot guarantee entry.
a. How to book at a bookable property:
i. Visit the participating property’s website, click ‘Book a Visit’.
ii. Select your tickets.
iii. Click ‘Select your session’.
iv. Choose your visit date during the redemption period.
v. Choose your session time and click ‘Book’.
vi. Click ‘Go to Basket’.
vii. Enter discount code COLIN50 in the discount code box and click ‘Apply’.
viii. If your basket includes the correct tickets during the redemption period the discount will be applied.
ix. Click ‘Checkout’ to complete the transaction. Once completed you will receive a confirmation email.
x. Bring along both your booking confirmation and the 50% discount voucher. Present these to the National Trust team member on arrival. If printed, the 50% voucher must be surrendered.
b. Without both the booking confirmation and the Sparks discount voucher the National Trust cannot guarantee entry and you will be charged the full admission price.
General
23. By clicking on the link contained within your Sparks e-mail/Hub/App you acknowledge that this will re-direct you to a third-party website. M&S has no control over the availability or content of the National Trust's website and accepts no liability or responsibility for any loss or damage that may arise from your use of the National Trust's website.
24. You acknowledge that the National Trust may have separate privacy and cookie policies. M&S does not accept any responsibility or liability for such privacy and/or cookies policies and it is your responsibility to check such privacy and/or cookies policies before submitting any personal data on the National Trust's website.
25. The National Trust's website may contain links to other sites and resources provided by other third parties. M&S has no control over the availability or content of such other third party sites and resources and accepts no responsibility or liability for them or for any loss or damage that may arise from your use of other third party sites or third party resources.
26. You acknowledge that any admission ticket purchase made in connection with the Promotion will be made on the National Trust’s ticketing website and that the end-to-end sale and purchase will be between you and the National Trust. You acknowledge that the National Trust will process all card transactions in accordance with its own terms and conditions, which are contained on the National Trust confirmation email. M&S has no involvement in the sale and purchase of admission tickets made in connection with the Promotion or in the processing of any card transactions with the National Trust and M&S does not accept any responsibility or liability for any loss or damage that may arise from any purchase made through the National Trust's website in connection with the Promotion. For the avoidance of doubt, M&S does not take ownership or responsibility for any products or services to be supplied by the National Trust to you.
27. You acknowledge that the National Trust will manage all customer service enquiries, including any ticketing enquiries. The National Trust will manage all and any returns and refunds. Full details of the National Trust's terms and conditions can be found on the National Trust's confirmation email. For the avoidance of doubt, M&S has no involvement in any customer services enquiries (with the exception of the Colin the Caterpillar backpack), including any ticketing enquiries and/or any returns and refunds and M&S does not accept any responsibility or liability for any loss or damage that may arise from any customer enquiries, including any ticketing enquires and/or returns and refunds.
28. The Promotion is non-transferable, non-refundable and subject to availability. M&S makes no guarantee or representation as to the National Trust’s availability of the tickets available as part of the Promotion. There is no cash alternative.
29. M&S' obligations are limited to making the Promotion available to participating Sparks customers. M&S shall not be liable for any financial loss arising out of the refusal, cancellation or withdrawal of the Promotion or any failure or inability of a customer to take advantage of the Promotion for any reason.
30. No responsibility will be taken for late, lost, indecipherable or misdirected emails or for any failure of communication resulting from incorrectly supplied information.
31. M&S reserves the right to check the validity of any purchase and the identity of any Sparks customer and to refuse participation in the Promotion if M&S reasonably considers the customer to be in breach of the terms and conditions.
32. M&S reserves the right at any time in its sole discretion to cancel, modify or supersede the Promotion if it believes, in its sole discretion, that the Promotion is not capable or is likely not to be capable of being conducted fairly or as specified within these terms and conditions due to events beyond its control (including, without limitation, a virus, a computer bug or unauthorised human intervention) or any other cause beyond the reasonable control of M&S that could corrupt or affect the administration, security or normal course of the Promotion.
33. Nothing in these terms and conditions shall limit in any way M&S’ liability for death or personal injury caused by its negligence. Subject to that, M&S shall have no liability for any delay and/or failure to perform any obligation to the customer that is caused by: (a) technical problems of any kind which may limit or prevent any person's participation in the Promotion; (b) any loss or damage arising from or in connection with the allocation of the Promotion; (c) any act or omission of any third party; or (d) any other events beyond M&S’s control that may cause the Promotion to be disrupted or corrupted in any way.
34. If any of these terms and conditions are found by a court or regulator to be invalid or unenforceable the other provisions shall continue to apply.
35. We will do our best to resolve any problems relating to the Promotion, except in relation to availability, performance or discounts offered, which are the responsibility of the National Trust.
36. This Promotion shall be governed by the laws of England and Wales.
